1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Creator”, “User”, or “you”) and Goofybag Online Pvt. Ltd. (“Inclik”, “we”, “us”), governing your access to and use of the Inclik platform, website, mobile interfaces, social publishing APIs, and digital commerce services (collectively, the “Services”).
By creating an account, claiming a bio URL (e.g., inclik.com/@yourname), connecting a social media account, or using any Inclik widget, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Creator Accounts & Handle Ownership
Account Integrity: You must provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your credentials and all actions taken under your account.
Username & Handle Reservation: You are granted a revocable license to use your chosen username handle. Inclik reserves the right to reclaim, reassign, or suspend handles that infringe on registered trademarks, impersonate well-known public figures or brands, or engage in handle squatting.
3. Content Ownership & 100% Creator IP
Inclik makes no claim of ownership over any artwork, music, videos, digital files, custom links, blog writings, or branding assets you upload to your profile. All intellectual property rights remain exclusively yours.
Limited Service License: You grant Inclik a worldwide, non-exclusive, royalty-free license solely to host, cache, route, and display your uploaded content across our global edge content delivery network (CDN) to render your bio page to your audience.
5. Digital Commerce & 0% Platform Commission
0% Take Rate Policy:
Inclik charges 0% platform commission on sales made through your digital storefront, consultation calendar bookings, and tip jars. Creators keep 100% of their net sales (standard third-party payment gateway processing fees from Stripe or Razorpay apply).
Product Legality & Fulfillment: You are solely responsible for the quality, accuracy, legal compliance, and fulfillment of digital goods, courses, presets, and consultations sold through your bio page.
6. Subscriptions, Upgrades & Cancellations
Paid Plans (Pro & Creator): Paid plans unlock unlimited scheduled posts, advanced interactive widgets, custom domain mapping, and premium analytics. Subscriptions renew automatically on a monthly or annual cycle unless cancelled prior to the renewal date.
Cancellation & Refunds: You may cancel your subscription at any time from your Billing Settings. Your paid features will remain active until the end of the current billing cycle. We offer a 14-day money-back guarantee on annual plan initial purchases.
7. Prohibited Uses & Safety
You agree NOT to use Inclik to host, link to, or distribute content that:
- Contains malware, phishing links, credential stealers, or deceptive redirects.
- Promotes hate speech, violence, harassment, or illegal substances/firearms.
- Infringes on copyrighted material, trademarks, or trade secrets without authorization.
- Engages in spam, bot traffic manipulation, or artificial engagement inflation.
- Attempts to bypass or disrupt our Cloudflare Turnstile bot verification or rate limit defenses.
Violation of these safety guidelines will result in immediate profile suspension and termination of Services without refund.
8. AI Studio & Gemini Generation Guidelines
When using our Gemini AI Post Generator and copy assistant, you agree to review and verify AI-generated text before publishing. You are responsible for ensuring your published copy complies with advertising disclosure guidelines and platform rules.
9. Disclaimers & Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLIK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM YOUR USE OF THE SERVICES OR THIRD-PARTY SOCIAL PLATFORM API CHANGES. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
10. Termination, Governing Law & Contact
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
